1. About MASHAGAT
MASHAGAT is a technology platform that connects Customers seeking agricultural services with independent Service Providers offering tractors, agricultural equipment, skilled workers, labour, and other agricultural services available through the app.

MASHAGAT enables users to discover services, make bookings, and manage service-related interactions through the platform. MASHAGAT acts as a technology intermediary between Customers and Service Providers and does not directly provide agricultural services. Service Providers are responsible for the services they offer and perform.

These Terms & Conditions govern the use of the MASHAGAT platform by all users.

2. Eligibility
Users must be legally capable of entering into a binding agreement, provide accurate information, verify their mobile number using OTP, and use the platform only for lawful purposes. Users must be at least 18 years of age or otherwise legally permitted to enter into binding agreements under applicable law.

3. User Accounts
Users are responsible for maintaining accurate profile information, protecting access to their account, and all activities performed through their account.

4. User Types
MASHAGAT may be used by Customers who seek agricultural services, Service Providers who offer services through the platform, and authorised Administrators who manage the platform.

Customers may browse available services and request bookings. Service Providers may list services and manage booking requests, subject to applicable subscription requirements. Administrators may manage platform operations in accordance with their authorised access and responsibilities.

5. Booking Services
Customers may request bookings for services listed on MASHAGAT. Service Providers may accept or reject booking requests and update booking status in accordance with the platform's functionality.

A booking is considered accepted when the relevant Service Provider accepts the booking through the app. Booking availability depends on the Service Provider's availability, applicable subscription requirements, and acceptance of the booking request.

Submitting a booking request does not guarantee that the requested service will be provided.

6. Responsibilities of Customers
Customers must provide accurate booking details and work locations, remain available at the agreed time, treat Service Providers respectfully, and fulfil agreed payment obligations where applicable.

Customers are responsible for ensuring that the service requirements and arrangements are clearly communicated to the relevant Service Provider.

7. Responsibilities of Service Providers
Service Providers must provide accurate service information, maintain up-to-date availability, communicate applicable service charges clearly, and perform accepted services professionally and respectfully.

Service Providers are responsible for the quality, safety, legality, and delivery of the services they provide, subject to applicable law and these Terms.

Service Providers must maintain an active subscription when required to offer services through MASHAGAT.

8. Payments
Payments for agricultural services arranged through MASHAGAT are the responsibility of the Customer and the relevant Service Provider unless an official payment system is provided through the platform.

Service Providers are responsible for clearly communicating applicable service charges to Customers before confirming the service arrangement. Users must ensure that any direct payments between them are lawful and that payment arrangements are mutually understood.

Provider subscription fees, where applicable, are governed by the subscription terms and payment instructions displayed through MASHAGAT. Users should review the applicable plan details and charges before making a subscription payment.

MASHAGAT does not collect or store debit card numbers, credit card numbers, CVV codes, UPI PINs, or internet banking passwords through the app.

MASHAGAT is not responsible for direct monetary settlements between Customers and Service Providers except to the extent required by applicable law or expressly undertaken through an official payment system provided by MASHAGAT.

9. Provider Subscriptions and Free Trial
MASHAGAT offers subscription plans to eligible Service Providers who wish to offer services through the platform.

Free Trial: When a Service Provider adds their first service to MASHAGAT, they are eligible for a one-time one-month free trial , subject to the applicable trial terms.

Subscription Plans: After the free trial, Service Providers may choose from the available subscription durations of one month, three months, six months, or one year. Applicable fees and plan details will be displayed before the subscription is requested or purchased.

Subscription Requirement: An active subscription is required for Service Providers to offer services through MASHAGAT. If a Service Provider does not have an active subscription or their subscription expires, they cannot offer services through the platform until an eligible subscription becomes active.

Other App Functions: Service Providers may continue using other app functions that do not require an active subscription, subject to the applicable platform rules.

Customers: Customers do not need a subscription to browse available services, make bookings, or receive services through MASHAGAT.

Subscription Approval and Validity: Subscription activation, validity, renewal, expiry, and access are subject to the applicable subscription terms and the status displayed in the app. Any subscription request or payment verification process must follow the instructions provided by MASHAGAT.

MASHAGAT may update subscription offerings and pricing from time to time. Any applicable changes will be communicated through the platform.

10. Cancellation and Refund Policy
Booking Cancellation: Bookings should only be cancelled when necessary. Repeated cancellations, fake bookings, or misuse of the booking system may result in account restrictions, temporary suspension, or permanent termination.

Subscription Fees and Refunds: Provider subscription fees paid to MASHAGAT are non-refundable. Once a subscription payment has been completed and the subscription has been activated, the fee will not be refunded, including where a Service Provider chooses to stop using the platform or does not fully use the subscription period.

Service Providers are responsible for reviewing the applicable subscription plan, duration, and fees before making a subscription payment.

Nothing in this policy limits any refund rights or remedies that cannot lawfully be excluded under applicable law.

11. Ratings and Reviews
Users may submit reviews based only on genuine booking experiences. Fake, abusive or misleading reviews are prohibited. MASHAGAT reserves the right to remove reviews that violate these Terms or applicable law.

12. Account Deactivation and Deletion

Users may deactivate or permanently delete their accounts using the applicable options available in the MASHAGAT app.

Account deactivation restricts account access but does not necessarily permanently delete the account or all associated records.

When a user permanently deletes their account, MASHAGAT processes the deletion in accordance with its account deletion procedure and Privacy Policy. Certain booking, payment-related, rating, subscription, and other necessary business records may be retained where required for legitimate business purposes, dispute resolution, fraud prevention, security, or compliance with applicable laws.

Users are encouraged to save copies of booking details and other information they may need for future reference. Information that is no longer required and is not subject to a lawful retention requirement will be deleted or anonymised in accordance with the applicable data retention procedures.

13. Prohibited Activities
Users must not provide false information, create fake bookings, misuse the platform, harass other users, attempt unauthorised access or upload illegal content.

• Impersonating another person or organisation.

• Attempting to interfere with the security, availability or proper functioning of the platform .

14. Limitation of Liability
MASHAGAT operates as a technology platform that connects Customers with independent Service Providers. Unless expressly stated otherwise, MASHAGAT does not directly perform the agricultural services arranged between users.

Service Providers are responsible for the services they offer and perform. MASHAGAT does not guarantee the availability, quality, suitability, or successful completion of every service.

Users should communicate service requirements, charges, schedules, and other arrangements directly with the relevant party.

Nothing in these Terms excludes or limits any liability or rights that cannot lawfully be excluded or limited under applicable law.

15. Intellectual Property
The MASHAGAT name, logo, software, graphics and content belong to MASHAGAT unless otherwise stated. No part of the platform may be copied, reproduced or distributed without prior written permission from MASHAGAT.

16. Privacy
Use of the platform is also governed by the MASHAGAT Privacy Policy.

17. Suspension or Termination
MASHAGAT may suspend or terminate accounts that violate these Terms or misuse the platform.

18. Changes to the Terms
MASHAGAT may update these Terms & Conditions from time to time. Updated Terms will be published on the MASHAGAT website or through the app, together with the applicable update date.

Where required by applicable law, users will be notified of material changes and their consent will be obtained where necessary. Users should review the updated Terms periodically.

19. Force Majeure
MASHAGAT shall not be liable for delays or failures in performing its obligations to the extent caused by events beyond its reasonable control, including natural disasters, floods, droughts, pandemics, government actions, internet failures, power outages, or other unforeseen events.

20. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or the use of the MASHAGAT platform shall be subject to the jurisdiction of the competent courts as determined under applicable law.

These Terms & Conditions constitute the entire agreement between the User and MASHAGAT regarding the use of the platform.
